Notable Cases

(1) DUI jury trial with an opened beer and an entire opened case of beer also found in my client's car. Not Guilty. (2) Negotiated a nolle-prosse for a man found sleeping in the driver's seat of a car parked in the middle of the road, with the door ajar, in the middle of the afternoon in broad daylight, with the radio blasting music and beer cans strewn throughout the car and the street. The argument of a lack of actual physical control along with the possibility that someone else drank the beers or that the car was never driven while my client was intoxicated was accepted along with additional mitigating factors (3) Aggravated assault with a deadly weapon jury trial where client was PRR reduced to simple assault. (4) Motion to suppress granted and case dismissed of a search of a woman with drug's stored in her private area that was found at the jail (5) Motion to suppress granted and case dismissed of a traffic stop for felony suspended driver's license due to law enforcement not following the speeding statute (6) Motion to suppress granted and case dismissed for a homeless woman sitting next to a bag of narcotics at a gas station due to lack of apparent notice (7) Motion to suppress granted and case dismissed for a search of a vehicle for couple at a public park due to law enforcement's failure to understand the local ordinance properly... Plenty more war stories... as you can see I enjoy defending our 4th Amendment rights.
