Area Served

Brian's main practice is on the Kansas side of the Kansas City metropolitan area, including Leavenworth and Lawrence, but he also handles cases across the State of Kansas.


Brian Leininger defends those accused of DUI, driving under the influence of drugs (DUID), and DUI-related batteries and homicides. He was formerly General Counsel to the Kansas Highway Patrol and a state and municipal prosecutor. Brian is certified to administer the Standardized Field Sobriety Tests and as an SFST Instructor. He is a trained operator of the Intoxilyzer and is the only defense lawyer in Kansas, and one of few in the world, to have completed training as a Drug Recognition Expert, which is the police training used to detect DUID drivers. Brian is a frequent local and national lecturer on DUI and DUID and has been named to the Super Lawyers list every year since 2008. He is currently President of the Kansas Association of Criminal Defense Lawyers.

Litigation Experience

Brian has represented clients in around 80 jury trials and over 200 bench trials. He has argued numerous cases before the Kansas Court of Appeals and Kansas Supreme Court and has submitted an amicus curiae brief to the United States Supreme Court.

Instructional Experience

Brian has lectured at many events for many groups across Kansas. He also has spoken at the International Association of Chiefs of Police Impaired Driving Conference in Portland and to the NORML Legal Committee in Key West.
